Riots, Routs, and Unlawful assemblies, are misdemeanors at common law, and therefore will be found fully mentioned under that class of offences; SENTENCES. Transportation for life, or for any term not less than seven years; or imprisonment for any term not exceeding four years, with or without hard labour, and with or without solitary confinement. 7 W. 4. & 1 V. c. 36. ss. 31. 41,42. but some acts of rioting are made felonies by statute: they are the following:--Offences against the Riot Act.--By the 1st section of the 1 G. 1. stat. 2. c. 5. (commonly called the Riot Act) it is enacted "that if any persons, to the number of twelve, or more, being unlawfully, riotously, and tumultously assembled together, to the disturbance of the public peace, and being required or commanded by one or more justices of the peace, or by the sheriff of the county, or by his under-sheriff, or by the mayor, bailiff or bailiffs, or other head officer or justice of the peace of any city or town corporate, where such assembly shall be by proclamation to be made in the king's name in the form thereinafter directed, to disperse themselves, and peaceably to depart to their habitations, or to their lawful business, shall, to the number of twelve or more (notwithstanding such proclamation made), unlawfully, riotously, and tumultously remain or continue together by the space of one hour after such command or request made by proclamation, that then such remaining or continuing together to the number SENTENCES.
